An educational institution is bound to refund admission fee of a student if he/she opts out before a course has started and the vacant seat goes to another candidate, the national consumer court has ruled. The National Consumer Disputes Redressal Commission directed the College of Science and Technology, Vishakhapat-nam under hra University to refund the fee charged from a student, Janjanam Jagedeesh, who withdrew from M.Sc. in Animal Biotechnology course in 2004. It said the institute could retain Rs. 1,000 towards processing fee from the Rs. 80,915 Jagedeesh deposited.

“Institute was unfair in retaining the entire fee, even after the student withdrew from their college,” the commission said in its July 6 order.

The order assumes significance in view of the practice followed by most schools and colleges, of not refunding admission fee even if a student withdraws before classes commence.

The Commission ordered that Jagedeesh’s money be refunded along with an interest of six per cent per annum within two months, failing which “the petitioners (college and university) will pay interest at the rate of 10 per cent per annum from the date of complaint till its payment”.

In its defence, the college and university cited a Supreme Court ruling, which said a university, did not render any service and therefore, students could not claim to be a consumer. But the National Commission rejected the argument, saying the SC order was in the context of conduct of examination only.

    Admission Application Date: 15-Feb-2014
    Admission Withdrawal Date: 03-Mar-2014 (by e-mail) and 08-Mar-2014 (by written)
    I have withdraw my son admission from Euro School, Wakad within 30 days of application. The term is not started yet (so my child not attended even single day in school). But the admission team of school told me that you have signed the form in which clearly indicated that in case of withdrawal we will not give back the admission fee (i.e. 25,000/- Rs.).
    So please guide me what can I do to get back the admission fee.

    Hello,i am Ashutosh singh and i took admission in a private college of a trust on July 2013,but after few months i want to withdraw my admission due to my reasons after 6 months(approximately) and i deposit 23000 rs.,this is my 1st installment and my exams of that course is not organized yet too,so is it possible that i get back my deposit money and if yes what to do for getting it back?????please help me sir,am waiting for your reply

    I have deposited Hostel fee for the entire year fee with 1st installement fee of 2nd year for PGDM course for my daughter. In the end of Nov-13 she left the college & joined job at Mumbai.
    College asked for 2nd installment fee which I am ready to pay but I want refund of Hostel fee for entire second half which in any case not will be utilised by her.
    College refused to adjust/refund Hostel fee in tution fee. Kindly help me.

  4. sir, I have submitted my full year hostel fee which included two semesters , but due my health reasons I am not able to adjust myself in the hostel, so can I get my second semester fee refunded back ,legally.

    Hello Sir i took admission in Rai university last month! due to its long timings which they did not say during admission and being an hour away from home it was uncomfortable for me to continue and even the college dint seem so promising! they took fees of whole year for both first and second sem, now they are refusing to refund the money even of second semester which is around 25,000! for travelling i paid for college bus for six months, even that they refuse to refund which is 11,000! In total i paid 70,000. at least i should get 50% refund back but they are not responding! please help me how to solve this problem its urgent!i have got admission in other college and want this refund as in that university certainly there was no issue of seats. they took admissions of how many ever they wanted like in our class it was considered a batch of 60 seats but we had 74 and some evn had very late admissions! Please advice what we should do!

    • Hi, you have complete right to demand the refund of the fees paid for the second semester and can in many cases, court reward back the proportionate amount of the current semester, if you can show that the college was able to fill up the vacated seat.

      In any case, you should make correspondence in writing, firstly keep proper evidence of communication made by you to the University of the fact that you wish to withdraw. And further you should also correspond with them in writing demanding the refund of fees, certificates, etc.

      And if still no action is taken, then you can proceed legally by getting them served with a legal notice demanding complete refund of fees along with compensation for harassment.

    Dear Sir,
    My Wife took the admission in Janakidevi Bajab College of Science,Wardha.(Maharashtra)for Msc.(Botany) 1st year on dated 5-Sept-2013 & paid Rs.5000/-for fees (total fees of college is 27000/-) but suddenly because of some personal reason we want to cancel it. But Collage said we should complete 25% of total fees(means Rs.5000+1750 = 6750/-)then you can get back your original documents from college.
    What Should I do & what is Rules about it please answer

    • This is sheer blackmail, its just a week since payment of fees, you will have to push hard but will surely get back not only documents but 90% of the fees paid. You should keep correspondence in writing and preserve proper evidence. And after waiting for a week, you can get a legal notice served upon them through an advocate.

    Hi,
    One of my friend was seeking admission for second year egg. after completion of her diploma in one of the college in Pune. college has taken all her original documents and took some registration fees (5K) and gave only written receipt on blank paper (without any college stamp etc.) that too without “filling college admission form”. When she went back to college saying she is not willing to take the admission and want her money and documents back, college demanded 50% of the total annual fees to return her original documents. When she raised this issue to college secretory he responded her in very abusive language telling her “do what ever you want we will not return your documents” until you pay.
    Can some one please guide what she should do in this case?
